General terms and conditions – Rental Schaller Radrennsport
- Scope of Application
The rental is provided by Schaller Radrennsport, located at 3007 Bern, which owns the rented goods. These Terms and Conditions (GTC) are an integral part of the rental agreement. By signing the agreement, the customer confirms that they have read, understood, and accepted these rental conditions unconditionally. No distinction is made between the different rented items. These GTC cover the entire rental assortment, including all rented items (road bikes, gravel bikes, mountain bikes, cycling shoes, bike cases, rental helmets, navigation devices, saddlebags, etc.). - Contractual Relationship
The contract is concluded between Schaller Radrennsport (the lessor) and the customer (the tenant/renter). - Definition of the Rented Item
The images of the rented items displayed on our website may differ from the actually available rented items. The images only define the category and type of item. Therefore, we do not guarantee that the reserved rental item matches the one actually available. Model or component differences are possible. - Price/Payment
The prices published by Schaller Radrennsport are applicable. The rental price must be paid online during the booking/payment via credit card/PayPal. Prices include all taxes and legal fees. In the case of booking the rental on-site, payment can also be made in cash or by EC/Postcard. Rental fees must be paid before the rental period begins. If the exact duration of the rental cannot be clearly defined before the rental starts, the minimum rental duration will be paid in advance, and the difference will be invoiced when the rented items are returned. Part days are charged at the full daily rate. The rental items must be returned by the store closing time the day before or at the agreed time to avoid additional charges. Bicycles can be reserved online through the Schaller Radrennsport website. To confirm the reservation, payment must be made online. A reservation and payment confirmation will then be sent to the customer’s registered email address. - Cancellation/Modification of Reservation
Up to 24 hours before the start of the rental, the reservation can be modified or canceled without charges (by phone or in writing via email). After this period, the reservation is considered final. Any price differences will be settled directly in the shop at the time of rental. This means:-If the reservation is canceled up to 24 hours before the rental start, no fee is charged, and the amount already paid is refunded 100%. The refund will be made to the customer’s credit card or PayPal account within the following days.
-If the reservation is canceled within 24 hours of the rental start, a fee of 50% of the total rental amount will be charged.
-If the customer fails to appear for the reserved rental, the full rental amount is due. There is no right to a refund of the payment made.
- Liability/Insurance
The lessor disclaims any responsibility in case of accidents. Insurance is the tenant’s responsibility. By concluding the rental agreement, the tenant confirms that they have liability insurance and therefore sufficient coverage for the risks involved in riding the rented item. Liability also extends to damage costs such as expert fees, depreciation, or rental loss fees. For all rented items, the tenant can take out additional insurance for a supplementary fee, which covers damages to the rented item as well as theft. However, this insurance does not cover all costs. In the event of damage or loss of the rented item, a deductible of 200 CHF is the responsibility of the tenant. Without insurance, the tenant is fully responsible for all damages or total loss of the rented equipment, covered by their private liability insurance. - Defects/Damage/Loss or Theft of Rented Equipment
The tenant is responsible for the rented equipment as long as it is in their possession, meaning that in the event of loss, the tenant is liable. In this case, the current value of the rented item will be charged (calculated by the lessor). In the event of intentional damage to the equipment due to negligent handling, uncontrolled riding, or negligence, the tenant must cover the resulting damages. The equipment is inspected before being rented out to check for any «signs of use.» These are recorded in writing. In the event of a bicycle breakdown, the lessor is not obligated to organize the transportation back. The costs of transport must be borne by the customer. Every rental bicycle is equipped with an emergency repair kit (spare inner tube, tire lever, C2 cartridge, adapter). - Accident/Illness/Interruption or Cancellation During the Rental Period
In the case of an accident or illness, with a medical certificate, the remaining rental fee will be refunded. The partial day will not be refunded. In case of bad weather, the rental fee will not be refunded after the rental period has started. - Deposit Guarantee
No deposit is required when taking possession of the rented equipment. However, a copy of an official ID (identity card or passport) is required. - Reception and Return of Rented Equipment
Before each use, all rented equipment is checked, cleaned, and tested by a mechanic. The tenant is expected to understand how to handle the rented equipment. If not, a brief training session is recommended before receiving the equipment. Children under 16 must be accompanied by an adult. Children and young people under 16 who are not accompanied by an adult may only receive rental bicycles with written consent from their parents or legal guardians. Upon return, a functioning check is performed by the mechanic. Defects and wear due to improper use will be charged to the tenant. All rental items listed in the contract must be returned in proper condition. Any missing or defective equipment will be charged. - Use/Prohibitions of Rental Bicycles
The tenant agrees to comply with the road traffic regulations and to use the rental bicycle appropriately and with care. The tenant is responsible for all damages resulting from negligence or inappropriate use of the rented item, whether it involves the rented item or third-party property. Any misuse of the bicycles, carrying additional people, or crossing obstacles that may clearly damage the vehicle is not allowed. - Applicable Law and Jurisdiction
Schaller Radrennsport strives to resolve disputes amicably. If the parties cannot reach an agreement, legal action will be taken. This contract is governed by Swiss law. The Regional Court of Bern-Mittelland BE, located in Bern, has exclusive jurisdiction.
